Terms of Service

1.The agreement

These Terms of Service (the "Terms") govern your access to and use of osu!gacha (the "Service"), including the website, the game, and any related pages we operate. The Service is provided by Damjan Klobucar ("we", "us", "our"), a private individual, not a company, running osu!gacha as a free non-commercial hobby project, based in Rijeka, Croatia.

By signing in, opening a pack, or otherwise using the Service, you confirm that you have read these Terms, that you accept them, and that you are legally able to enter into this agreement. If you do not accept them, do not use the Service.

Two further documents form part of this agreement and are incorporated by reference: our Privacy Policy and our Cookie Policy.

These Terms take effect on 14 August 2026 and were last updated on 14 August 2026.

2.Who we are not affiliated with

We use the official osu! OAuth service to sign you in, and public follower data published by Mutualify to build the card pool. Your use of osu! itself remains governed by ppy's own terms and privacy policy, which we do not control.

3.Eligibility and age

• You must be at least 13 years old to use the Service.
• If you are under 16 (or the age of digital consent in your country, if that is higher), you may only use the Service with the permission of a parent or guardian, who accepts these Terms on your behalf.
• You must have a valid osu! account and comply with ppy's terms when using it.
• You must not be barred from using the Service under any applicable law, and you must not use it if we have previously terminated your access.

If we learn that a user is below the minimum age, we will close the account and delete the data associated with it.

4.Signing in and your account

You sign in with your osu! account through OAuth. We only request the "identify" scope, which gives us your osu! user ID, username and avatar URL. We never see or receive your osu! password, and we cannot act on your osu! account.

• You are responsible for everything that happens through your account, and for keeping access to your osu! account secure.
• You may not share, sell, rent or transfer your osu!gacha account or its contents to anyone else.
• You may not create additional or automated accounts to obtain more packs, promo rewards or cards than a single player would receive.
• Tell us promptly if you believe someone else has used your account without permission.

You can stop using the Service at any time by signing out. To have your account and its data deleted, follow the process in the Privacy Policy.

5.Cookies are required to use the Service

The Service cannot function without storing a session cookie on your device: without it, the server has no way to tell whose collection to load or save. For that reason, the game area is locked until you accept cookies.

• If you reject cookies, we sign you out, clear the local data we control, and the game becomes non-interactive. This is the only honest way to respect that choice, because we cannot run the game without storage.
• If you try to interact with the game while cookies are rejected, we will show the consent prompt again. Accepting it is the only way to continue.
• These Terms, the Privacy Policy and the Cookie Policy stay fully readable whether or not you accept cookies.
• You may withdraw your consent at any time using the "Cookie settings" link in the footer.

6.Your licence to use the Service

We grant you a personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Service for your own private, non-commercial entertainment, in line with these Terms. We reserve every right not expressly granted to you.

7.Packs, cards and other virtual items

• Packs are provided free of charge and regenerate on a timer. There is nothing to buy, and no payment of any kind unlocks items, odds or content.
• Because no item can be bought and nothing can be cashed out, the game is not gambling and is not a game of chance for money.
• Virtual items are non-transferable between accounts and cannot be traded, sold or given away, whether on or off the Service.
• We may change, rebalance, add, remove, expire or reset virtual items, drop rates, the card pool, promo codes and game mechanics at any time, including resetting collections during development.
• Virtual items are lost if your account is closed or terminated, and we owe you no compensation for them.

Pack contents are determined by a random draw at the moment you open the pack. The chance of each rarity, of a shiny, and of a signed card is set out in the game's odds display. We may adjust these odds, and we will update the in-game display when we do.

8.Promo codes

• Promo codes are personal, single-use per account, and have no cash value.
• Codes may expire, be capped, or be withdrawn at any time, and rewards are subject to in-game limits such as the maximum pack count.
• Using scripts, brute force or leaked lists to find or mass-redeem codes is prohibited and may result in termination.

9.Donations

Donations through Ko-fi are entirely voluntary gifts to support hosting costs. They do not buy packs, cards, odds, priority or any other benefit in the game, they create no contract for goods or services, and they are non-refundable except where the law requires otherwise. Payments are handled by Ko-fi and their payment providers under their own terms; we never receive your card details.

10.Acceptable use

You agree not to:

• use bots, scripts, macros, automation or any tool to open packs, redeem codes or interact with our API;
• scrape, crawl or bulk-download the Service, or use it to build a competing dataset or service;
• exploit a bug, glitch, race condition or unintended behaviour instead of reporting it to us;
• circumvent, disable or tamper with rate limits, authentication, the consent gate or any other technical measure;
• reverse engineer, decompile or attempt to derive our source code, keys or credentials, except to the extent this cannot lawfully be restricted;
• probe, attack, overload, or disrupt the Service or the infrastructure it runs on, including through denial-of-service or credential-stuffing attacks;
• impersonate another player, misrepresent your affiliation with us, or use the Service to harass, defame, or infringe the rights of anyone;
• upload or transmit anything unlawful, malicious, or infringing; or
• use the Service in breach of any applicable law, sanction or export control, or in breach of ppy's terms.

Security researchers acting in good faith are welcome: report what you find to us privately first, do not access other players' data, and give us a reasonable chance to fix it before disclosing.

11.Suspension and termination

We may suspend or terminate your access, remove virtual items obtained in breach of these Terms, or restrict features, if we reasonably believe you have breached these Terms or the law, or to protect the Service, other players or ourselves. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to respond.

You may end this agreement at any time by stopping use of the Service and asking us to delete your account. Sections that by their nature should survive termination (including intellectual property, disclaimers, liability, and governing law) continue to apply.

12.Intellectual property

• The Service's code, layout, card frames, artwork, animations and text are owned by us or our licensors and are protected by copyright and other rights.
• osu!, the osu! logo and related marks belong to ppy Pty Ltd. Player usernames, avatars and signatures belong to the players themselves.
• Player data used to build the card pool comes from public osu! profile information, sourced through Mutualify.
• You may share screenshots and card links for personal, non-commercial purposes, including on social media. Everything else requires our written permission.

If you believe content on the Service infringes your rights, email miztosu@gmail.com with a description of the work, the URL where it appears, your contact details, and a statement that you are the rights holder or authorised to act for them. We remove infringing content promptly once verified.

13.Players featured on cards

Cards feature osu! players using their public username, avatar and public profile statistics. Featured players are not endorsing the Service, are not paid by it, and have no involvement in it. Signed cards use signatures provided to us voluntarily by the players concerned.

If you are a featured player and you want your card, your avatar or your signature removed, email us at miztosu@gmail.com from an address we can verify, or contact us through the osu! account linked in the footer. We will remove you from the card pool without asking for a reason.

14.Third-party services and links

The Service links to and relies on services we do not control, including osu! (ppy Pty Ltd), Mutualify, Supabase, our hosting provider, Ko-fi and Discord. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms.

15.Availability, changes and wipes

• The Service is provided free of charge and on an "as available" basis. We do not promise any level of uptime and may take it offline for maintenance at any time.
• We may add, change, suspend or discontinue any part of the Service, including the game itself, at any time.
• The Service is under active development. Collections, pack counts and other progress may be reset, corrected or migrated, and we may need to roll back data after a bug or an exploit.
• We may change these Terms. If a change materially affects your rights, we will give notice in the game or on this page before it takes effect. Continuing to use the Service after that means you accept the new Terms; if you do not, stop using the Service and ask us to delete your account.

16.Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that virtual items, drop rates or collection data will be preserved, or that defects will be corrected.

17.Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, for loss of profit, goodwill, opportunity or data, or for the loss of virtual items, collections or progress, however caused.

Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the total amount you have paid us in the twelve months before the claim, which for a free service is normally nothing, and (b) EUR 50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

18.Indemnity

You agree to indemnify and hold us harmless against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the Service, or your infringement of anyone else's rights. This does not apply to the extent the claim results from our own breach or negligence, and it does not apply to consumers where local law prohibits it.

19.Your statutory rights

If you use the Service as a consumer, nothing in these Terms removes rights you have under the mandatory consumer law of your country of residence, and you may bring proceedings in the courts of that country where local law gives you that right.

20.Governing law and disputes

These Terms and any dispute arising from them are governed by the laws of the Republic of Croatia, without regard to conflict-of-law rules. Disputes will be brought before the competent courts in Rijeka, Croatia, subject to the consumer rights described above.

Before starting formal proceedings, please contact us — most problems are quicker to fix informally, and we will try to resolve any complaint within 30 days.

21.General

• If any provision of these Terms is found unenforceable, the rest stays in force and the provision is applied as closely as possible to its intended meaning.
• If we do not enforce a right straight away, we do not waive it.
• You may not assign these Terms; we may assign them to a successor who takes over the Service, provided your rights are not reduced.
• These Terms, with the Privacy Policy and Cookie Policy, are the entire agreement between us about the Service.
• There are no third-party beneficiaries to this agreement.
